Terms of Service
DRAFT — English translation of the Polish draft; the Polish version is binding. To be reviewed by a lawyer before publication. Fields
[[…]]to be completed.
Version: 0.1 (draft) · Effective from: [[date]]
1. Operator and contact
The app [[hub name]] ("App") and the apps and courses available in it ("Content") are provided by
[[company name]], [[address]], [[tax / registration number]] ("Operator"). Contact: [[e-mail address]].
2. Definitions
- User — a person using the App, with or without an account.
- Account — a User account identified by an email address.
- Subscription — paid, auto-renewing access to part of the Content, bought in Google Play or the Apple App Store ("Store").
- Creator — an entity whose app or course is available in the App (
[[currently only the Operator]]).
3. Use of the App
- The App requires a
[[Android / iOS]]device or a web browser and internet access; some Content works offline once downloaded. - The App is intended for people aged
[[16]]+; younger people may use it with a guardian's consent. - The App is free to use, except for Subscriptions (§ 6).
- Creating an Account requires accepting these Terms.
4. Account
- You create an Account with your email address, confirmed with a code. There are no passwords.
- You are responsible for access to your mailbox; anyone with access to it can sign in to your Account.
- One person may have one Account; Accounts are not transferable.
- You can delete your Account at any time (Profile → Delete account, or
[[/legal/usun-konto]]). Deletion is irreversible. An active Subscription is not cancelled automatically — cancel it in the Store (§ 6.5). - The Operator may block an Account for breaching § 7, after a prior warning unless the breach is gross.
5. Content and licence
- Content is protected by copyright and belongs to the Operator or Creators.
- You get a non-exclusive, non-transferable licence to use the Content for personal, non-commercial purposes, in the App, while you use it (paid Content — for the duration of the Subscription).
- Copying, distributing, decompiling the App, circumventing protections and automated downloading are prohibited.
- Content you create in the App remains yours; the Operator processes it only to run the App.
- The Operator may change, add and remove Content; removing Content covered by an active Subscription entitles you to a pro-rata refund (§ 6.7).
6. Subscriptions and payments
- Price, billing period and scope are shown in the App before purchase and in the Store; prices include VAT.
- Payments are handled by the Store; the Operator has no access to card details.
- Subscriptions renew automatically at the same price unless cancelled at least 24 hours before the end of the current period.
- Free trial (if offered):
[[length]]; afterwards it becomes paid unless cancelled. - Cancel in the Store settings. Deleting the App or the Account does not cancel a Subscription.
- After cancellation, access lasts until the end of the paid period.
- Refunds are handled by the Store under its rules; other requests are reviewed individually (§ 10).
- Right of withdrawal (EU consumers): 14 days for digital content; by starting to use paid Content earlier
you consent to immediate delivery and acknowledge losing that right.
[[Lawyer: check consumer law and Store requirements.]] - Price changes apply from the next period with
[[30]]days' notice; you may cancel free of charge. - A Subscription is tied to the Store account; use "Restore purchases" on another device.
7. Rules of use
Prohibited: breaking the law or these Terms, accessing other Accounts, interfering with the App or bypassing Subscriptions, posting unlawful or offensive content or spam, scraping and automated account creation.
8. Liability
- The Operator strives for uninterrupted operation but does not guarantee availability at all times; planned maintenance is announced in the App.
- Content is educational/informational; the Operator is not liable for decisions based on it.
- Towards consumers, statutory liability applies and is not limited by this section.
- Towards non-consumers, liability is limited to the amount paid for Subscriptions in the last 12 months.
9. Changes to the Terms
The Operator may change the Terms for important reasons with [[14]] days' notice in the App and by email. If
you do not accept a change, you may delete your Account.
10. Complaints and disputes
Complaints: [[e-mail address]], answered within [[14]] days. Consumers may use the EU ODR platform
(https://ec.europa.eu/consumers/odr). Governing law: [[Polish]], without prejudice to mandatory consumer law.
11. Final provisions
Personal data: [[/legal/prywatnosc]]. Referral programme: [[/legal/polecenia]]. Google and Apple are not
parties to the agreement and are not responsible for the App. In case of discrepancies, the [[Polish]]
version prevails.
